Event Registration Agreement

For good and valuable consideration, including but not limited to participating in the designated event(s) (“Event”) hosted or in conjunction with the BIPOC Kids on the Block, LLC (“BKOTB”), the undersigned, on behalf of themselves and any minor children named below, hereby stipulate and agree:

1.       Assumption of Risk. I understand and acknowledge that the activities that take place at the Event may be dangerous and may involve the risk that I or my child(ren) will sustain serious injury, temporary or permanent disability, death, and/or property damage. I understand that the activities that take place on the Premises may not be supervised and that BKOTB does not provide medical services. I further acknowledge that any injury I or my child(ren) may sustain while participating at the Event may be compounded by negligent or delayed medical service. I VOLUNTARILY AND FREELY ASSUME ALL RISKS AND DANGERS THAT MAY OCCUR PURSUANT TO ME OR MY CHILD(REN) PARTICIPATION AT THE EVENT, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE.

2.       Release from Liability. I hereby agree, on behalf of myself, my child(ren), my heirs and my personal representatives, to fully and forever discharge and release BKOTB, and its partners, agents, operators, officers, members, managers, employees, and representatives (“Released Parties”) from any and all claims I or my child(ren) may have or hereinafter have for any injury, temporary or permanent disability, death, damages, liabilities, expenses and/or causes of action, now known or hereinafter known in any jurisdiction in the world, attributable or relating in any manner to the Event, whether caused by the negligence of BKOTB or any of the Released Parties or by any other reason. I acknowledge and agree that this Release and Waiver of Liability is intended to be, and is, a complete release of any responsibility of the Released Parties for any and all personal injuries, temporary or permanent disability, death, and/or property damage sustained by me or my child(ren) arising from the Event.

3.       Covenant Not to Sue. I agree, for myself and my child(ren), my heirs, not to sue the Released Parties or initiate or assist in the prosecution of any claim for damages or cause of action against the Released Parties which I, my child(ren), or my heirs may have as a result of any personal injury, death or property damage I or my child(ren), may sustain arising from the Event.

4.       Indemnification. I hereby agree to defend, indemnify and hold harmless BKOTB and the Released Parties from and against any third party losses, damages, actions, suits, claims, judgments, settlements, awards, interest, penalties, expenses (including reasonable attorneys’ fees) and costs of any kind for any personal injury, loss of life or damage to property sustained by reason of or arising out of my or my child(ren)’s, participation in the Event.

5.       Authorization of Medical Care. BKOTB’s managers, members, and employees (BKOTB Staff) are not physicians or medical practitioners of any kind. With this in mind, in the case of injury or illness during participation in the Event I hereby release BKOTB Staff to render temporary first aid to my child(ren) in the event of any injury or illness, and if deemed necessary by the BKOTB Staff to call our doctor and to seek medical help, including transportation by a BKOTB Staff member and or its representatives, whether paid or volunteer, to any health care facility or hospital, or the calling of an ambulance for said child should the BKOTB Staff deem this to be necessary.  BKOTB does not carry medical insurance for participants and I forever release BKOTB, and its partners, agents, operators, officers, members, managers, employees, and representatives, and other related parties from the responsibility or liability for insurance deductibles, medical expenses, and/or other damages incurred by my child(ren), myself, or other family members while participating or visiting the Event or related facilities, parking area, or traveling to or from, or at a related activity. I expressly agree and promise to accept and assume all of the risks existing in this activity as outlined above.

I hereby waive, release and discharge forever BKOTB and its partners, agents, operators, officers, members, managers, employees, and representatives from any and all claims, liabilities, demands or causes of action whatsoever that may arise from the rendering of first aid to me or my child(ren) for injuries arising on or around the property of BKOTB or that may arise in the transportation of me or my child(ren) to a medical facility.  I affirm that I now have and will continue to provide proper health insurance coverage. 

6.       Responsibility for Personal Property. I acknowledge and agree that I and my child(ren), am fully and solely responsible for any of my or my child(ren), property and personal belongings that I or my child(ren), bring to the Event and that BKOTB will not be responsible for or provide any security for my or my child(ren)’s, property and personal belongings.

7.       Photo Consent.  I consent to photograph, film and videos being taken of myself, and my child(ren) by BKOTB or its agents and understand that such pictures will become the property of BKOTB.  They may used by BKOTB for promotional purposes without the payment of fees or other compensation to me or my child(ren).

8.       Parent Responsibility to Supervise.  When I attend a BKOTB Event, or am involved in any related activity involving parental presence or participation, I understand and accept the responsibility, and any associated liability, of constantly supervising, controlling, and restricting activities as necessary to assure safety of the children I bring and myself.

9.       Billing and Payment for Event(s).  I understand that participation/registration fees for Event(s) must be paid in advance.  I understand that BKOTB does not provide refunds for missed Event(s). 

10.     Non-Discrimination.  BKOTB does not discriminate based on age, sex, race, color, marital status, physical or mental disability, religion, national origin, sexual orientation, gender identity or expression, pregnancy, childbirth or related medical condition, genetic information, military or veteran status or other legally protected status.  Participants in BKOTB Events are expected to treat others with courtesy and respect. 

11.     Governing Law and Venue. This agreement will be governed by and interpreted in accordance with the laws of the State of New Hampshire, without giving effect to the principles of conflicts of law of such state. I and my child(ren), agree that any action arising out of this agreement must be brought exclusively in any state or federal court located in the state of New Hampshire.

12.     Waiver and Severability. No waiver of any term or right in this Release and Waiver of Liability agreement shall be effective unless in writing, signed by an authorized representative of the waiving party. The failure of any party to enforce any provision of this agreement shall not be construed as a waiver or modification of such provision, or impairment of its right to enforce such provision or any other provision of this agreement thereafter.  If any provision or portion of this Release and Waiver of Liability agreement shall be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect.

13.     Entire Agreement; Modification; Binding Effect. This Agreement is the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior agreement or communications between the parties, whether written, oral, electronic, or otherwise. No change, modification, amendment, or addition of or to this agreement shall be valid unless in writing and signed by authorized representatives of the parties. This agreement shall be binding upon and inure to the benefit of the successors, assigns, and legal representatives of the parties.

I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ AND UNDERSTAND EACH OF THE ABOVE PROVISIONS. I ACKNOWLEDGE THAT PRIOR TO SIGNING THIS AGREEMENT I HAD THE OPPORTUNITY TO CONSULT WITH AN ATTORNEY TO REVIEW THIS AGREEMENT. I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT, AND I EXECUTE THIS AGREEMENT VOLUNTARILY AND FOR ADEQUATE CONSIDERATION INTENDING TO BE FULLY BOUND.
